Trump Administration Moves to Remove Brake-Pedal Requirement for Autonomous Vehicles

The Trump administration has proposed a major regulatory change that could accelerate the deployment of fully autonomous vehicles in the United States. The U.S. Department of Transportation (DOT) announced a proposal to eliminate the federal requirement for brake pedals in vehicles designed to operate exclusively with automated driving systems. If approved after a 30-day public comment period, the rule would remove one of the biggest regulatory obstacles facing companies developing purpose-built robotaxis, including Tesla and Zoox.

Under current Federal Motor Vehicle Safety Standards (FMVSS), vehicles must generally include traditional driving controls such as brake pedals and steering wheels. Companies wishing to deploy vehicles without these features must apply for exemptions from the federal government, and even approved exemptions limit the number of vehicles allowed on public roads. Removing the brake-pedal requirement would allow manufacturers to bring fully autonomous vehicles to market more quickly without relying on these exemptions.

The proposal continues a broader effort by U.S. regulators to modernize vehicle safety rules for autonomous technology. During the Biden administration, the National Highway Traffic Safety Administration (NHTSA) finalized regulations allowing autonomous vehicles to operate without steering wheels. More recently, the Trump administration has proposed eliminating other outdated requirements, including certain windshield wiping, defogging, and tire-labeling standards for self-driving vehicles.
